1. Introduction
If you are here, you have reached us by downloading, registering or installing any of Night Street’s interactive software products, including Last Flag (the “Game(s)”), or by visiting [https://lastflag.com], or one of the other websites owned or operated by Night Street Games, Inc. or its affiliates (collectively, the “Sites”), or by accessing our content, events, applications, services, patches, updates, tools, or other online or offline offerings (collectively, the “Services”). Night Street is committed to protecting your privacy. This Privacy Policy (“Privacy Policy”) explains our collection, use, disclosure, retention, and protection of your personal information, as well as your rights to your data under applicable U.S. and international law. We may refer to Night Street Games, Inc. and its subsidiaries herein, collectively as “Night Street”, “we”, “our”, or “us.” Also, please note that unless we define a term in this Privacy Policy, all capitalized terms used in this Privacy Policy have the same meanings as in our applicable Terms of Service and End User License Agreement (“EULA”). Please make sure that you have read and understand both our Terms of Service and EULA. Where we are required to identify a data controller pursuant to regulation, Night Street is the designated controller of the data we collect. Night Street is not the data controller for personal information collected directly by third-party platforms, consoles, digital storefronts, or service providers through which you access the Games (each, a “Platform” and collectively, the “Platforms”). Such information is collected and processed by the applicable Platform pursuant to its own privacy policies and terms, and Night Street does not control or assume responsibility for such processing.
This Privacy Policy applies to our Games, the Sites, and our Services where this Privacy Policy is referenced, regardless of how they are accessed. This Privacy Policy does not apply to any third-party websites, services, or applications, even if they are accessible through our Services.
This Privacy Policy describes:
the information we collect, how we collect such information, and the purposes of our collection;
how we use and with whom we share such information;
how you can access and update your information; and
how we protect the information we store about you.
Disclosure to Residents of the United States: Laws in certain U.S. states give residents specific rights with respect to the personal information collected about them. In our efforts to comply with applicable U.S. state law, we ask and advise that U.S. residents review the “Additional Information for U.S. Residents” at Section 14 of this Privacy Policy for additional information on how we handle your personal information, and the privacy requests you may make under applicable law.
2. Information We Collect
When you interact with our Services, we may collect and store information from you directly as described below:
2.1 Platform Identity & Player Data
Last Flag does not have its own account registration system. You access the Game through your existing Steam or Epic Games Store account or other applicable Platform, and Night Street receives limited information from those Platforms — such as your Platform user ID, username, and region — as authorized by your Platform account settings. Night Street uses Pragma as its game backend platform to facilitate this integration with Steam and Epic Games Store, enabling player identity management, matchmaking, and in-game features.
We associate gameplay data with your Platform identity, including matchmaking history, match results, player ratings, and in-game settings. You may change your display name within the Game; this name may be visible to other players during gameplay.
Night Street does not control and is not responsible for the terms, policies, or practices of any Platform, including Steam, Epic Games Store, or Pragma, and your use of those platforms is governed solely by their respective terms and privacy policies.
2.2 Information You Provide Directly
Communications: Information you provide when you contact us for customer support, submit feedback, or communicate with us through email or other channels.
In-Game Chat: If in-game chat is available, messages sent during gameplay may be recorded and stored to protect user safety and enforce community standards.
Survey and Research Data: Information you voluntarily provide in user surveys or research participation.
Transaction and Purchase Data: If we offer in-app purchases, a game store, or other paid features, we may collect information about your purchase history, items purchased or unlocked, and transaction identifiers. Actual payment processing (including credit card and billing information) is handled by the applicable Platform (e.g., Steam, Epic Games Store) or a third-party payment processor, and we do not directly collect or store full payment card information.
2.3 Information We Collect Automatically
When you access or use our Game or Services, we may automatically collect:
Technical and Device Information: IP address, device type, operating system, hardware specifications, browser type and version, language settings, and unique device identifiers.
Location Information: We may derive a rough geographic location (such as country or region) from your IP address to personalize and improve the Services, including for matchmaking and localized content.
Usage and Gameplay Information: Data related to how you play the Game, including gameplay statistics, progression data, match results, player levels, campaign progression, game settings, and actions taken within the Game.
Log Data: Server logs, timestamps of access, crash reports, diagnostic information, player-versus-player sessions and rankings, and game state.
Cookies and Similar Technologies: We use cookies and similar technologies on our Sites to collect information such as browser type, time spent on the Services, pages visited, language preferences, and other traffic data. You can adjust your cookie preferences through your browser settings; however, disabling cookies may affect your ability to access certain features of the Services. Third-party service providers may also place their own cookies on your device, and their use is governed by their own privacy policies. We encourage you to review the privacy policies of the third-party service providers listed in Section 4.1 of this Privacy Policy.
2.4 Information from Third Parties
We may receive information about you from third parties, including:
Platform Information: When you access the Game through a Platform (e.g., Steam or Epic Games Store), we may receive your Platform user ID, username, country/region, and other information as authorized by your Platform account settings.
Game Backend Services: We use Pragma as our game backend platform, which integrates with Steam and Epic Games Store to manage player identity, matchmaking, sessions, and in-game features. Pragma may process your Platform user ID, display name, and gameplay data on our behalf as a service provider.
Anti-Cheat Services: We use third-party anti-cheat services (such as Easy Anti-Cheat) that may collect information about software running on your device to detect unauthorized programs.
Third-Party Providers: We may also receive information about you from other third-party data providers where permitted by applicable law.
Third-Party SDKs: Our Games and Services may incorporate third-party software development kits (SDKs) for analytics, authentication, game backend services, or anti-cheat functionality. These SDKs may independently collect certain data from your device or gameplay session in accordance with their own privacy policies. We encourage you to review the privacy policies of the third-party service providers listed in Section 4.1 of this Privacy Policy.
We do not condition participation in our Services on you providing more personal information than is reasonably necessary for that activity.
3. How We Use Your Information
We use the information we collect for the following purposes:
To Provide and Operate the Services: Enabling you to download, install, and run the Game; providing matchmaking, gameplay features, and related game services; communicating with you about the Services; and providing customer support.
To Improve and Develop the Services: Conducting performance analyses and testing; troubleshooting bugs and errors; developing new features and content; and understanding how users interact with our Game and Services.
To Promote Safety, Security, and Integrity: Detecting and preventing cheating, hacking, fraud, and other prohibited behavior; enforcing our Terms of Service, EULA, and community standards; and protecting the rights, property, and safety of Night Street, our users, and others.
To Comply with Legal Obligations: Responding to valid legal requests and processes; complying with applicable laws and regulations; and maintaining business records as required by law.
To Communicate with You: Sending you newsletters, updates, and promotional content (where you have opted in or where permitted by law); responding to your inquiries and requests; and keeping you informed of in-game activity and status updates. Each promotional communication will offer you the ability to withdraw consent and opt out of future messages.
3.1 Legal Bases for Processing Your Information: Where applicable under the European Union’s General Data Protection Regulation (GDPR) or equivalent legislation in other jurisdictions, our legal bases for processing your personal information are:
Performance of a contract: Processing necessary to provide you with the Game and Services under our Terms of Service and EULA.
Legitimate interests: Processing necessary for our legitimate interests, including improving the Services, promoting safety and security, and understanding our users, provided these interests are not overridden by your data protection rights.
Consent: Processing based on your specific consent, where applicable (you may withdraw consent at any time).
Legal obligation: Processing necessary to comply with our legal obligations.
4. How We Share Your Information
We do not sell your personal information. We may share your information with third parties in the following circumstances:
Service Providers
We share information with third-party service providers who perform services on our behalf, such as hosting, analytics, anti-cheat services, customer support tools, game backend services, and email delivery. These providers are contractually obligated to use your information only as directed by us and to maintain the confidentiality of any information disclosed to them.
We may also share aggregated or anonymized information — which is not specifically identifiable to you — with prospective partners or other third parties for lawful business purposes.
Platforms
When you access the Game through the Platforms (e.g., Steam or Epic Games Store), certain gameplay and usage information may be shared with or accessible by the Platform in accordance with the Platform's own privacy policies.
Other Players
Your display name may be visible to other players during gameplay, on leaderboards, and in matchmaking. Access to this information is limited to what is necessary for the gameplay experience.
Legal Requirements and Harm Prevention
We may disclose your information where we have a good-faith belief that it is necessary to: (i) comply with applicable law, legal process, court order, or government request; (ii) detect, prevent, or address fraud, security, or technical issues; (iii) protect the rights, property, or safety of Night Street, our users, or others; or (iv) enforce our Terms of Service or EULA.
Business Transfers
In the event that Night Street undergoes a merger, acquisition, reorganization, bankruptcy, or similar business transaction, your information may be transferred to the successor organization as part of that transaction.
With Your Consent
We may share your information with third parties when you have provided your explicit consent to do so.

5. Children’s Privacy
Our Services are not directed to children under the age of 13 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at [support@nightstreetgames.com].
For residents of the European Economic Area (EEA) and UK, “child” means a person under the age of digital consent as defined by the applicable law of their country of residence.
6. Your Rights and Choices
Depending on where you live, you may have some or all of the following rights regarding your personal information:
Access and Portability. You may request access to or a copy of your personal information.
Correction. You may request that we correct or update inaccurate personal information.
Deletion. You may request that we delete your personal information.
Objection and Restriction. You may object to our processing of your personal information or ask us to restrict processing in certain circumstances.
Withdrawal of Consent. Where we rely on your consent to process your personal information, you may withdraw that consent at any time.

Please note that certain records — for example, those relating to customer service matters or legal obligations — may be retained even following a deletion request. We are also unable to delete data controlled solely by third parties where Night Street does not act as a data controller or processor. For example, if you access the Game through Steam or Epic Games Store, you will need to make any deletion or data requests to those Platforms separately.
Please note that requests to restrict or delete your data may affect your ability to access certain gameplay features if we require that information to provide the Services to you.
6.1 Residents of the EEA or UK. If you reside in the EEA or UK, you may lodge a complaint with your local data protection authority. Contact details for EEA Data Protection Authorities are available at https://edpb.europa.eu. The UK Information Commissioner's Office can be contacted at https://ico.org.uk.
6.2 Opt-Out of Promotional Communications
You may opt out of receiving promotional emails and product updates from Night Street by unsubscribing in any such email or by updating your communication preferences. Your request will be processed promptly, generally within ten (10) business days. Please note that even if you opt out of promotional communications, we may still contact you for transactional or Service-related purposes, such as responding to support inquiries, notifying you of changes to this Privacy Policy or our Terms of Service, or for other legitimate non-marketing reasons.
We do not share your personal information with third parties for their direct marketing purposes unless you have affirmatively opted in to such sharing in connection with a specific promotion. You may opt out of any such sharing at any time by contacting us at [support@nightstreetgames.com].
7. Data Retention
We retain your personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including to satisfy any legal, regulatory, tax, accounting, or reporting requirements. When we no longer need your personal information, we will securely delete or anonymize it.
8. Cookies and Similar Technologies
We use cookies and similar technologies on our Sites to collect information about your browsing behavior and preferences. We use the following types of cookies:
Necessary Cookies: Required for the Sites to function properly.
Analytics Cookies: Help us understand how visitors interact with our Sites.
Preference Cookies: Allow us to remember your settings and preferences.
You can manage your cookie preferences through your browser settings. We do not currently respond to browser do-not-track signals.
9. Security of Your Information
We implement appropriate administrative, technical, and physical safeguards to protect your information from accidental or unauthorized loss, misuse, access, disclosure, alteration, or destruction. However, no internet transmission is ever fully secure or error-free, and we cannot guarantee the absolute security of your information while it is being transmitted through our Services. Any transmission of your data is at your own risk.
10. International Data Transfers
Night Street Games, Inc. is headquartered in Las Vegas, Nevada, United States. Your personal information may be transferred to, and processed in, the United States and other countries where Night Street or its service providers maintain facilities. These countries may have data protection laws that are different from those of your jurisdiction.
For transfers of personal information from the EEA, UK, or Switzerland to the United States or other countries that have not been deemed to provide an adequate level of data protection, we rely on appropriate transfer mechanisms, including European Commission-approved Standard Contractual Clauses, to protect your personal information.
11. Social Media and Third-Party Links
Our Services may include links to or integrations with third-party websites, services, or social media platforms (such as Discord). Any information you share on or through those platforms is subject to their own privacy policies, and we encourage you to review them. We are not responsible for the privacy or security practices of any third-party service. We only access information you make publicly available through our official social media pages and do not receive any private account information from any social media platform.
12. Playtest Data Provisions
When you participate in playtesting, early access, or beta programs for our Games, we may collect additional data in connection with your participation. This may include gameplay telemetry and performance metrics recorded during the playtest session; session recordings or replay data capturing in-game actions and events; written, verbal, or structured feedback and survey responses you provide; bug reports, crash logs, and diagnostic information generated during your playtest session; and communications between you and our development team related to the playtest.
Playtest data is used solely to improve and develop the Games and Services, diagnose technical issues, and understand how players experience pre-release content. We do not use playtest telemetry or recordings for advertising targeting. Playtest data is retained only for as long as necessary to support the applicable development cycle, after which it is deleted or anonymized in accordance with our standard retention practices. Participation in a playtest program may be subject to additional non-disclosure or testing agreements, which will be provided to you at the time of enrollment.
13. Advertising and Analytics
We currently do not serve third-party advertisements within our Games. However, we use analytics tools (such as Google Analytics) to understand how users interact with our Sites and Services. These analytics providers may use cookies or similar tracking technologies and may collect usage data about your interactions with our Services. Such analytics data is used to improve our Services, understand player behavior, and support our legitimate business interests.
If we introduce advertising in the future — including advertising for our own products or through third-party ad networks, ad mediators, or advertising SDKs — we will update this Privacy Policy accordingly. In such cases, ad-related data collection may include your device identifiers, approximate location, and gameplay or usage information for the purpose of serving relevant ads and measuring ad performance. We will not serve personalized ads based on sensitive personal information.
14. Additional Information for U.S. Residents
14.1 California Residents
If you are a California resident, you have additional rights under the California Consumer Privacy Act ("CCPA") as amended by the California Privacy Rights Act ("CPRA").

We may collect personal information from the following sources: directly from you (e.g., customer support inquiries); indirectly through your use of the Game and Services; from Platform providers such as Steam and Epic Games Store; and from third-party service providers such as Pragma and Easy Anti-Cheat.
We Do Not Sell or Share Your Personal Information. Night Street does not sell personal information as defined by the CCPA. Night Street does not share personal information for cross-context behavioral advertising purposes.
Global Privacy Control. We will treat Global Privacy Control ("GPC") signals received from your browser as a valid request to opt out of the sale or sharing of personal information associated with that browser.
Shine the Light. California's "Shine the Light" law (Civil Code Section 1798.83) permits users of our Sites who are California residents to request information about our disclosure of personal information to third parties for direct marketing purposes. Our policy is not to disclose personal information to third parties for their own direct marketing purposes without your consent. California residents may submit such a request by contacting us at [legal@nightstreetgames.com].
14.2 Business Purpose Disclosures
In the preceding twelve (12) months, we have disclosed the following categories of personal information for business purposes: Identifiers; Internet or network activity information; Geolocation data; and Inferences drawn from personal information.
We may disclose personal information for business purposes to the following categories of third parties: service providers (such as hosting, analytics, anti-cheat, customer support, and game backend providers); our affiliates; and third parties you authorize us to share with in connection with the Services.
When we disclose personal information for a business purpose, we enter into a contract requiring the recipient to keep that information confidential and use it only for the specified purpose.
14.3 California and other U.S. State Privacy Rights
In addition to California law, certain U.S. state privacy laws, including, without limitation, the laws of Colorado, Connecticut, Nevada, Utah, and Virginia may provide residents specific rights regarding their personal information. Depending on your state of residence, you may have some or all of the following rights. These rights are not absolute and may be subject to certain exceptions and limitations:

Request correction of inaccurate personal information
Be informed about the categories of personal information we collect, the sources, and the third parties with whom it is shared

We will first acknowledge your request within ten (10) business days and endeavor to respond within forty-five (45) days. If we require additional time, we will notify you in writing of the reason and the extension period. We do not charge a fee to process verifiable requests unless they are excessive or repetitive. We may need to verify your identity in order to process your request to exercise your data rights, and we reserve the right to confirm your identity and residency, and in our discretion, deny your request if we are unable to verify your identity or residency.
Please note that requests to restrict or delete your data may affect your ability to access certain gameplay features if we require that information to provide the Services to you.
14.4 Authorized Agents
You may authorize someone to submit a request to exercise your privacy rights on your behalf (an authorized agent). Authorized agents must provide documentation demonstrating your authorization or power of attorney under applicable law. We reserve the right to verify your identity and the agent's authorization directly with you before processing the request.
14.5 Appeals and Non-Discrimination
If we deny your request relative to the exercise of your privacy rights, you may appeal by contacting us at [legal@nightstreetgames.com]. We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge different prices, or provide a different level of quality based on your exercise of any privacy rights, except as permitted by applicable law.
15. Changes to Our Privacy Policy
We reserve the right to change this Privacy Policy at any time. Any information that is collected via our Services is covered by the Privacy Policy in effect at the time such information is collected. If we decide to make material changes to our Privacy Policy, we may notify you and other users by placing a notice on [https://lastflag.com/privacy-policy] or by sending you a notice to the email address we have on file for you, and we’ll update the “Last Updated” date above. We may supplement this process by placing notices in the Games and on the Site.
